Halloween Parties And Your Home Insurance

Halloween is one of the most favorite times of year.  All kinds of events happen on this day, including Halloween Parties.  You will have your friend John dressing up like a giant banana and Suzie dressing up like Little Red Riding Hood.  Some people are going to have Halloween Parties this year.  Here are some things to think about before you host your Halloween Party at your home.

  • Make sure before hosting a party that you have a clear path from the street to your door.  Make sure there are no potential tripping hazards or delinquencies that could cause a slip and fall.  If you have snow on Halloween shovel your driveways, walkways and lay down salt in order to melt ice.
  • Make sure to confine your pets not only because people can trip and fall over them but you don’t want your pet to run away or get hurt.
  • Make sure all areas where people are going to be walking including dining room, living rooms, sidewalks, bathrooms and dens are well lit so people have a clear view of where they are walking.
  • Do not use open flames.  Even though this is a party killer, do not light candles because people have the tendency to knock them over and start a fire.  Use the electrical lights for your candles and your jack-o-lanterns.
  • If you are serving food, make sure that perishables don’t sit out too long.  You do not want your guests to get sick from food you serve.
  • If you are planning to serve alcohol, make sure you don’t serve your guests too much, and make sure they have a way home.  This can be a Taxi Cab or assign a designated driver.
  • Test all safety devices including fire alarms if applicable, test smoke detectors, and make sure your fire extinguisher is up to date.

In conclusion, a renter, a homeowner and a landlord can be potentially held liable for any incidents or accidents that occur on a property.  Make sure your homeowners, renters or landlord policy has enough medical payments liability coverage and premises liability coverage.  We recommend at least $5,000 Medical Payments and $300,000 liability coverage on homeowners. The Liability Of Halloween Trick Or Treaters On Your Property

Halloween can be a great and fun time of the year. Those little pumpkins come to the door and say “Trick or Treat” and you give them all kinds of candy. Many Moms and Dads walk along with their children in gathering those little treats, and even sometimes grandmas and grandpas. As We all know they come on your property, ring your door bell and you give out goodies. The unforeseen threat is when the “trick or treaters” come  on your property, you could potentially be held liable for anything that could happen. This is if someone slips o falls, or any other type of “accident”. This could be if you are  a renter, homeowner or landlord. There are a couple of ways to prevent and protect yourself and we are going to explain what to do.

What To Do To Your Property To Prepare For Trick Or Treaters

  • Make sure there is a clear path from the street to your door. Make sure there is enough space for people to walk.
  • Have the area’s well-lit with light. This is so people can see clearly where they are walking on your property.
  • If its snows, shovel your driveway and walkways, and lay down salt. This is to prevent slip and falls.
  • Don’t have any hazards in the way or attractive nuisance’s.  This could be a hole you are digging in your lawn, or a pile of lumber or rocks in your yard.

Check Your Home Insurance Policy

Make sure your homeowners or renters policy has enough liability and medical coverage. We at least recommend having $5,000 in Medical Payments Coverage and having at least a $300,000 liability. Increasing these coverages will at most cost you an extra $50 dollars per year.  If someone sues you or there is a monetary judgement held against you due to an incident, your home insurance policy protects you.

Ordinance And Law Coverage On A Home Owners Insurance Policy

This could be your primary dwelling, seasonal property, rental condo or home. As newer homes are being built, your house keeps its individuality.  As we know, new code laws are either being updated or made to help try to improve, energy, safety, and other purposes. As a homeowner with your old house, this doesn’t effect you, because its most likely grand fathered in. Or Does it?

Most of the time it doesn’t effect the average homeowner. But when it comes to the possibility of a  insurance loss on your home or property, everyone can become vulnerable to new code laws. The chances are the older your home or structure, the less compliant they are with current codes. In the event of a total or partial loss of your property, for example due to a fire, when it is re-built it has to be compliant with all new county, city, city, state, federal and association codes.

This will cover you three ways:

  1. Loss to undamaged part of building or dwelling. (Example: The part of the undamaged building has to be demolished and rebuilt due to code.)
  2. Increased Demolition Cost: (Due to having to demolish and undamaged part of the building or dwelling)
  3. Increased Cost Of Construction. (Due to higher cost for compliance for new law codes)

Coverage is usually built in at, %10 of the structure/dwelling insurance amount. This can be increased with an endorsement or when a policy is started.

Will my home insurance policy pay to fix a broken sewer line?

It s always a devastating experience to have a sewer break take place with your home.  It is not only inconvenient, troublesome, but expensive.  As an insurance agent I get a lot of questions, this is one of the most common questions I get.  Not only is this true of homeowners, it is true with commercial lines as well.  “Will my insurance policy pay for a broken sewer line?”  To give a short answer to this questions, no and yes.

Sewer backup coverage only covers the damage due to a sewer backing up.  For example, the pipe clogs towards the middle or towards the street on your sewer line, causing sewage and water to back up in your house and small flooding, the insurance will pay for the damage caused from the sewer backup.

What decides if a insurance company will pay for a broken sewer line, all depends on the condition of the pipe and how old it is.  If the sewer line breaks due to it being old, and it needs to be replaced, then the insurance company is not going to pay out anything.  Insurance companies don’t pay for maintenance, they only pay for accidental and sudden losses.

The industry rarely pays out on this type of incident. The only time they were to possibly consider, is if its not due to a warranty issue, and the line must be up to date and new. Even then, there is more than likely no coverage. For Example: an insurance company will not pay out on a 50 year old clay line, that broke due to natural wear and tear and its at the end of its life use.

What Is Renters Or Tenants Insurance or Known As A Ho-4?

A HO-4 policy, also known as renter’s insurance, covers only the tenants interest. This includes the following coverage,

So Why Should I As Landlord, Require  My Tenants to have Tenants Insurance?

To avoid any legal problems or losses from your tenant.  A Renters Policy has a personal liability built in.  If your renter were to encounter any legal problems or losses, she/he is covered.  Here are some examples of what could happen.

-A renter invites a guest over and they slip and fall on the premises.

-They could accidentally start a fire in the premises.

With renters insurance, any type of law suits, or premises losses are going to fall on their policy. If your renter does not have insurance, you as a landlord are going to have to use your own policy.  Requiring your renter to have insurance can avoid huge headaches in the event of a loss or legal problems. The last thing you need to deal with as a landlord is getting sued for one of your tenant’s actions. In additon if a loss does occur on your policy, chances are your premium is going to increase on next renewal.

How much personal liability coverage should your renter have?

All you should be worry about on your tenant’s policy is their personal liability.  I would recommend a $300,000 liability requirement and it costs the tenant $15.00 – $30.00 per year extra.  This for the most part will cover most law suits that a tenant could encounter.  This for the most part covers the average cost of a dwelling or condo if were to completely burn to the ground.  If you feel that this will not be sufficient, your renter could go with a $500,000 personal liability or higher.

How much does Renters Insurance cost my tenant? 

Depending on how much coverage the tenant decides to go with besides your liability requirements, it can run as low as $80 per year all the way up to $300.  A lot of this depends upon the renters credit, previous losses, and how much other coverage they decide to buy and etc.

How do I get Proof Insurance As A Landlord?

You should get a Certificate of Insurance or Coverage Confirmation from the company or agent writing the insurance policy. I would also recommend getting listed as an additional insured on the policy if possible. That way you are always getting notified on any major policy changes, but mostly if the policy is being cancelled for any reason. Just like the insured, you get a policy packet  in the mail with detailed coverages, and notifications just like the tenant would.
